When we provide services to a business customer under a separate agreement, that customer may be the controller (or equivalent) for end-user or employee data they provide to us, and we may act as a processor (or service provider) under that agreement and any data processing addendum. This website policy does not replace those contract terms.
2. Categories of personal information we may collect
Depending on how you interact with us, we may collect the categories below. We collect only what we need for the purposes described here.
- Identity and contact data: name, email address, phone number (if you provide it), company name, role or title, and mailing details when relevant to a business engagement.
- Inquiry and project data: messages, intent (for example project, enablement, security questionnaire, waitlist), city or market notes you share, and related commercial context.
- Account or product interest data: waitlist preferences, product interest, and updates you request.
- B2B customer and partner data: business contact details, contract and billing contacts, delivery communications, and information needed to perform professional services.
- B2C end-user data: where our consumer-facing products or waitlists collect information you submit (for example name and email for launch notifications).
- Technical and security data: IP address, device and browser type, approximate location derived from IP, timestamps, referral URL, and logs used to secure and operate the Services.
- Communication records: emails and support threads you send to us.
3. Sources of information
- Directly from you (forms when enabled, email, meetings, contracts).
- From your organization when it designates you as a business contact.
- Automatically from your device when you browse our website (technical and security logs).
- From service providers that help us host, deliver email, or operate infrastructure, acting on our instructions.
4. How we use personal information
We use personal information for legitimate business purposes, including:
- Responding to inquiries, security questionnaires, and project or enablement requests.
- Providing products, services, waitlist and launch updates you requested.
- Performing B2B contracts, delivery, support, and relationship management.
- Operating, securing, troubleshooting, and improving the website and Services.
- Preventing fraud, abuse, and unauthorized access.
- Complying with law, enforcing agreements, and protecting our rights and users.
- Improving the Services using aggregated or non-identifying insights where practical, without selling personal data.
5. We do not sell personal data
We do not sell personal information. We do not share personal information for cross-context behavioral advertising. We do not rent or trade mailing lists.
If the meaning of “sale” or “share” under a particular privacy law is broader than ordinary commercial sale, our position remains: we do not sell or share personal information for monetary or other valuable consideration in the advertising sense those laws target.
7. How we store and protect information
We store B2B and B2C personal information using administrative, technical, and organizational measures designed to protect it against unauthorized access, loss, misuse, and alteration. Measures may include access controls, encryption in transit where appropriate, least-privilege practices, logging, and vendor diligence.
No method of transmission or storage is perfectly secure. We work to reduce risk and to respond appropriately if an incident affects personal information we control.
8. Retention
We retain personal information only as long as needed for the purposes described in this policy, including to fulfill your request, maintain a customer or waitlist relationship, meet legal, accounting, or security requirements, and resolve disputes. When retention is no longer necessary, we delete, destroy, or de-identify the information in a manner consistent with our practices and applicable law.
10. Your privacy rights (United States)
Depending on where you live (including Texas under the Texas Data Privacy and Security Act, and other state privacy laws where applicable), you may have rights to:
- Confirm whether we process your personal information and access it.
- Correct inaccurate personal information.
- Delete personal information, subject to legal exceptions.
- Obtain a portable copy of personal information you provided, where required.
- Opt out of sale or targeted advertising (we do not sell or engage in that sharing).
- Appeal a refusal to act on a request, where your state law provides an appeal right.
To exercise these rights, email support@buhrn.com with the subject line “Privacy Request.” We may need to verify your identity before acting. We aim to respond within 1-2 business days, and in any event within the timelines required by applicable law. You will not be discriminated against for exercising privacy rights.
11. UK and European visitors and UK business relationships
We work with businesses and individuals in the United Kingdom, and visitors from the UK and European Economic Area may use our Services. Where UK GDPR, the UK Data Protection Act 2018, or EU GDPR applies to personal data we process, we respect applicable requirements of fairness, purpose limitation, data minimization, accuracy, storage limitation, integrity and confidentiality, and accountability.
Lawful bases we rely on may include: performance of a contract or steps prior to a contract; legitimate interests (such as securing our Services, responding to business inquiries, and improving our site in ways that do not override your rights); consent where we ask for it; and legal obligation.
UK and EEA individuals may have rights of access, rectification, erasure, restriction, objection, and data portability, and the right to withdraw consent where processing is consent-based. You may also have the right to lodge a complaint with the UK Information Commissioner’s Office (ICO) or another supervisory authority.
Because Buhrn is established in the United States, personal information may be processed in the United States and other countries where our providers operate. Where required, we use appropriate safeguards for international transfers, which may include contractual protections with recipients.
For UK business customers that provide us personal data of their staff or end users under a services agreement, roles and transfer terms are set in that agreement and any data processing addendum. Ask us for our standard DPA language when you need it for procurement.
12. Children
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. For UK users, we do not knowingly offer Services that require consent from children under the applicable digital consent age. If you believe a child has provided personal information, contact us and we will take appropriate steps to delete it.
13. Automated decision-making
We do not use personal information collected through this website to make solely automated decisions that produce legal or similarly significant effects about you.
14. Third-party sites and products
Our Services may link to third-party sites or app stores. Their privacy practices are governed by their own policies. We are not responsible for those practices.
15. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the effective date above. Material changes may also be highlighted on the site or by email where appropriate. Continued use of the Services after an update means you acknowledge the revised policy.
16. Governing law and venue
This Privacy Policy is governed by the laws of the State of Texas, United States of America, without regard to conflict-of-law rules, except where mandatory privacy laws of your place of residence (including UK data protection law) give you non-waivable rights that apply regardless of this choice of law.
Subject to those mandatory rights, exclusive venue for disputes arising out of this Privacy Policy or our privacy practices for the Services lies in the state or federal courts located in Harris County, Texas (Houston). You consent to personal jurisdiction there to the extent permitted by law.
